How do family members get their compensation?

South Carolina Code of Laws section 15-51-10 specifies which family members are entitled to receive compensation in a successful wrongful death lawsuit. In general, the following are entitled to the compensation:

  • A spouse or children of the deceased 
  • Parents of the deceased if there is no spouse or children 
  • Others who are entitled to inheritance under SC intestate laws if there are no parents, spouse, or children 

After a wrongful death settlement has been reached or after a jury verdict has been handed down, and all appeals have been exhausted, settlements will typically be paid out by the insurance carrier of the defendant (the at-fault party). If the defendant did not have insurance, they will be held personally liable for any judgment or settlement amount. 

Typically, these payments will be handed out in one of two ways:

  • One lump-sum payment to beneficiaries
  • A structured settlement paid to beneficiaries monthly over the course of years
