Jury Awards $11 Million in Gallbladder Medical Malpractice Case

A Georgia woman filed a medical malpractice lawsuit against Habersham Medical Center, et al., alleging that a botched gallbladder removal surgery caused life-threatening complications and irreversible damage to her internal organs. Recently, a jury agreed with her allegations and found the defendants liable for nearly $11 million in damages.

Life-threatening complications of gallbladder surgery

The plaintiff filed her medical malpractice lawsuit after undergoing what was supposed to be a routine gallbladder removal surgery in January of 2012. However, the surgeon inadvertently lacerated an artery during the procedure. According to a spokesperson for the plaintiff, she bled profusely from the injury. However, despite losing most of her blood, she was not given an emergency blood transfusion until after she was transferred from Habersham Medical Center to Northeast Georgia Medical Center. According to the spokesperson, the delay in blood transfusion led to “…devastating results that left her permanently impaired and profoundly disabled.”

In her lawsuit, Daniels named the surgeon and two nurse anesthesiologists as defendants, along with the hospital. However, the hospital and the surgeon settled the claims against them prior to the trial. After hearing testimony for seven days, the jury awarded Daniels nearly $11 million in compensatory damages. The jury awarded $7.2 million for past, present, and future medical damages, $3.5 million for pain and suffering, and $200,000 for lost wages. The settlement and verdict are expected to help Daniels recover from the severe internal bleeding that caused organ damage due to oxygen deprivation.
